Ordered to leave his home, a Moroccan man ultimately pays his debt and saves his lease on appeal

Born in Morocco, a tenant had been ordered, along with his partner, to leave their home after several unpaid rent payments. The couple settled their arrears after the deadline had expired. Yet the court of appeal has now wiped out the effects of the lease termination.

On September 8, 2025, the local court in Cagnes-sur-Mer ordered the couple’s eviction. The lease was declared terminated, and the tenants were ordered to pay an occupancy fee of 1,459.39 euros per month until they left.

The case had begun seven months earlier. The landlord, Caisse régionale du Crédit agricole Provence Côte d’Azur, was seeking 5,790.06 euros in rent and charges from them. A formal demand for payment had been sent to them on February 7, 2025.

The deadline expired on April 7. The couple eventually paid the amount on April 28, three weeks too late to automatically prevent the lease from being terminated. Other payments were then made late during the summer.

But the tenants did not stop paying. On September 25, 2025, their rental debt was fully paid off. They also resumed paying the rent as usual, initially set at 1,280 euros, plus 102 euros in charges.

The lease termination retroactively overturned

On appeal, the couple asked for the payments made after the deadline to be taken into account. The Aix-en-Provence court agreed and retroactively granted them extensions running from the formal demand for payment until the debt was paid off.

This decision changes everything. The termination clause is deemed never to have taken effect. The eviction is overturned, as is the monthly occupancy fee. The court thus applies a mechanism that allows a tenant who has resumed payments to save their lease before a final decision is handed down, according to the ruling of September 3, 2026.

The reversal contrasts with the case of an 88-year-old Moroccan man evicted despite paying off his rent arrears. Here, the couple keeps their home, although they remain liable for the costs caused by the initial missed payments.

Crédit agricole was still seeking 1,280 euros in damages for the late payments and wanted to deduct this amount from the security deposit. The court declared both claims inadmissible.
