Real estate in Morocco: an adoul will soon be able to handle a titled property anywhere in the Kingdom
Buying or selling a titled property in Morocco is about to become simpler. The new law on adouls removes a major territorial constraint, with particular benefits for MREs managing a property remotely.
An adoul will soon be able to draw up a deed concerning a registered property even if it is located outside the jurisdiction of the Court of Appeal on which the adoul’s office depends.

In practical terms, an MRE who owns, for example, a titled apartment in Agadir but handles the formalities in Casablanca will be able to choose an adoul there, without necessarily having to turn to a professional associated with the region where the property is located.
This new provision appears in Law 051.26 governing the profession of adoul, promulgated by dahir on July 28, 2026, and published in Official Gazette No. 7533 on August 10, 2026.
The text maintains the principle of territorial jurisdiction for adouls, but creates an explicit exception for contracts and testimonies relating to a registered property, even when it is located outside their jurisdiction.
No longer necessary to choose an adoul based on the property’s city
For owners, the change therefore provides greater freedom in choosing the professional responsible for drawing up the deed. This is particularly useful for Moroccans residing abroad, who often handle their formalities during short stays in Morocco.
The reform does not, however, abolish all territorial rules. The exception specifically concerns registered real estate. Other deeds remain subject to the rules set out in the new law.
The change is not immediate. The law will enter into force 90 days after its publication in the Official Gazette, that is, after August 10, 2026.

With this reform, the location of the titled property will therefore no longer, by itself, determine the choice of the adoul responsible for the real estate transaction.
