Undeclared House in Morocco: From 50,000 Euros, the Matter Becomes Criminal

An undeclared property in Morocco can turn a social assistance case into a criminal matter in the Netherlands. Once the damage reaches 50,000 euros, the municipality must refer the case to the public prosecutor’s office. This threshold concerns benefits improperly received, not the value of the property.

The discovery of an undeclared house, plot of land or inheritance share in Morocco can have criminal consequences for a recipient of “bijstand,” Dutch social assistance.

The municipality must first determine whether this asset would have reduced or eliminated the right to benefits. It then recalculates the amounts paid during the relevant period and claims back the money improperly received.

The value of the Moroccan property does not directly determine the amount of the debt. The official guide Handreiking inkomen en vermogen in het buitenland V2026 specifies that all benefits paid may be recovered, even when the property is worth less than the benefits claimed. Several factors are included in the calculation, notably the duration of ownership and the share actually held by the beneficiary.

The threshold concerns benefits

When the damage reaches 50,000 euros, the municipality must report it to the Dutch public prosecutor’s office. The case then falls under the criminal regime.

This threshold therefore does not correspond to the price of the house in Morocco. A relatively low-value property can lead to a referral to the public prosecutor’s office if concealing it made it possible to receive at least 50,000 euros in benefits improperly.

Below this amount, a report may exceptionally still be made, particularly when no administrative penalty can be imposed or its recovery appears practically impossible.

Referring the case to the public prosecutor’s office does not mean that the beneficiary will automatically be prosecuted or convicted. The public prosecutor’s office decides what action to take in the matter. In the event of criminal prosecution, the municipality may not additionally impose an administrative fine for the same facts. If the case is dismissed, however, this penalty may still be applied.

The obligation to declare also applies to a house occupied by the family or a share held with other heirs. The absence of rent or income derived from the property is not sufficient to exclude it from the asset calculation.
