A note from the National Land Registry Agency, issued on June 5, 2026, now imposes a strict obligation: all powers of attorney used for real estate transactions must be registered in a dedicated register of real rights.

This measure, effective for any deed signed since June 1, 2026, marks a turning point for the legal security of transactions in Morocco. From now on, the simple fact of having a drafted power of attorney is no longer sufficient to validate a property transfer or a modification of real rights. The document must necessarily appear in the powers of attorney register to produce its legal effects.

In practice, land registry officers have been instructed to systematically verify this registration when filing any contract. To prove their compliance, users must provide a copy or extract of the registration, established according to an official model defined by the Ministry of Justice. Without this formality, the file risks being simply blocked by the authorities.
The new rule is based on article 889-1 of the Code of Obligations and Contracts, recently amended. This reform aims to drastically limit the risks associated with obsolete or fraudulent powers of attorney. By centralizing this data, the administration seeks to guarantee that the document used has not been subject to any subsequent cancellation or modification, thereby strengthening the transparency of national real estate transactions.
